Terms of service
These terms (the "Terms") are an agreement between you and Fortavola ("Fortavola", "we", "us") and govern your use of the Fortavola restaurant back office service, including app.fortavola.com, admin.fortavola.com and api.fortavola.com (the "Service"). By using the Service you agree to these Terms. If you use the Service for a business, you agree to them on that business's behalf and confirm you are authorized to do so.
1. The Service
Fortavola provides software for running a restaurant's back office, such as invoice processing, price tracking, recipe costing, inventory and food cost. Features may change over time.
2. Accounts and access
Each business has an account. Account owners decide who is invited and what each person can do, and are responsible for the activity of the people they invite. Keep your sign-in details secure and tell us at info@fortavola.com if you believe your account has been compromised.
3. Your data
You keep all rights to the data you put into the Service ("Customer Data"). You give us permission to host, process and display Customer Data only as needed to provide and support the Service. Our privacy policy explains how we handle information.
4. Acceptable use
You agree not to misuse the Service, including by: accessing accounts or data you are not authorized to access; interfering with or disrupting the Service; uploading unlawful or malicious content; reverse engineering the Service except where the law allows it; or using the Service to break any law.
5. Connected services
The Service can connect to third-party services such as Intuit QuickBooks Online and Toast. Your use of those services is governed by their own terms. We are not responsible for third-party services, and a connection may stop working if the provider changes or ends its service. You can disconnect a service at any time.
6. AI features
Some features use AI to produce results, such as reading invoice lines or drafting recipes. These results can be wrong. Review them before relying on them, for example before approving an invoice or exporting it to your accounting system.
7. Fees
Any fees for the Service are those agreed with you in writing or shown in the Service. We will give notice before introducing or changing fees that apply to you.
8. Availability and changes
We work to keep the Service available but do not guarantee it will be uninterrupted or error free. We may update, add or remove features.
9. Ending use
You may stop using the Service at any time. We may suspend or end access if these Terms are seriously breached or if needed to protect the Service or others. After an account is closed, you may request an export of your Customer Data within 30 days.
10. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Figures the Service calculates, such as costs and variances, depend on the data entered and should be checked before you rely on them for business decisions.
11. Limitation of liability
To the extent the law allows, Fortavola will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.
12. Changes to these Terms
We may update these Terms. If a change is significant, we will notify account owners before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
13. General
These Terms are governed by the laws of [STATE], without regard to its conflict of law rules. If any part of these Terms cannot be enforced, the rest stays in effect. These Terms are the entire agreement between you and us about the Service, unless you have a separate signed agreement with us.
